Terms of Service

These Terms of Service govern access to hosted TvRMM, a remote monitoring and management service operated by vanRoojen LLC. They are written to protect customers, managed endpoints, and the service without creating surprise fees, hidden access rights, or cancellation traps.
1. Agreement
By creating an account, accepting an order, using the portal, installing an agent, or authorizing someone to use TvRMM for your organization, you agree to these Terms and the related policies listed at the end of this page.
If you use TvRMM for an organization, you represent that you have authority to bind that organization. If you do not have that authority, do not use TvRMM for that organization.
2. The service
TvRMM is hosted SaaS for endpoint monitoring and management. Depending on the endpoint type and current support state, TvRMM may provide enrollment, inventory, audit data, patch workflows, scripts, terminal sessions, reboot orchestration, agent updates, log collection, performance data, policy assignment, remote desktop access, homelab host inventory, and related operational workflows.
Feature depth varies by operating system, endpoint type, package manager, appliance policy, tenant role, and support state. Platform names, icons, or evidence labels do not create a promise that every workflow is available on every endpoint.
3. Accounts, tenants, and roles
Customers are responsible for:
- keeping account credentials secure;
- assigning roles only to people who should have that access;
- removing users who no longer need access;
- maintaining accurate tenant, organization, billing, and contact information;
- protecting endpoint bootstrap material and access tokens;
- ensuring that agents are installed only on systems the customer is authorized to manage.
TvRMM may rely on actions taken by users with valid credentials and sufficient role authority. The product includes role controls and operating-as role caps, but customers remain responsible for choosing the right people and permissions.
4. Endpoint authority
TvRMM is powerful software. Customers must have lawful authority to monitor and manage every endpoint, guest, host, account, network, log source, and appliance enrolled in or connected to TvRMM.
Customers are responsible for any scripts, commands, patch approvals, reboot instructions, configuration changes, remote sessions, or other actions they run through the service. Customers should test scripts and automations before using them broadly and maintain backups for systems they manage.
5. Customer data
Customer Data means data submitted to, generated in, or collected by TvRMM for a customer tenant, including endpoint inventory, audit data, command results, scripts, logs, users, organizations, billing records, feature requests, support records, and settings.
Customers retain ownership of Customer Data. TvRMM may process Customer Data to provide, secure, support, bill, improve, and operate the service; comply with law; prevent abuse; and enforce these Terms.
TvRMM does not claim ownership of customer scripts, operational records, endpoint data, or tenant content.
AI features
TvRMM does not use Customer Data with AI systems by default. Future AI-based features must be explicit opt-in and are intended to use bring-your-own provider keys, so customers control whether AI is enabled, which provider account is used, and what data is submitted through that provider.
Customers are responsible for reviewing any third-party AI provider terms, privacy settings, retention settings, and billing rules before enabling an AI workflow.
6. Support access
TvRMM staff should not silently enter customer tenants. Support access should be approved, scoped, time-limited, and logged. Emergency access may be used only when needed to protect the service, respond to security incidents, comply with law, or prevent harm, and should be recorded when technically and legally practical.
7. Billing
Hosted TvRMM billing is governed by the Billing, Refund, and Cancellation Policy. The standard hosted price is based on active real agents, with account-credit minimum payments, daily prorated usage, self-service agent limits, stale-agent exclusion after 30 days offline, and safe wind-down access after cancellation.
Customers authorize vanRoojen LLC and its payment processor to charge payment methods for applicable fees, taxes, and adjustments. Billing disputes should be raised promptly through the contact form or portal support path.
8. Acceptable use
Customers must follow the Acceptable Use Policy. TvRMM may suspend or restrict accounts, tenants, access tokens, agents, commands, or access when needed to stop abuse, protect customers, comply with law, or preserve service integrity.
9. Security responsibilities
TvRMM maintains security controls described in the Security and Responsible Disclosure Policy. Customers are responsible for endpoint security, local administrator access, endpoint backups, least-privilege role assignment, script review, safe credential handling, and compliance with laws that apply to their managed environments.
10. Beta, preview, and staged features
Some features may be labeled beta, preview, evidence-backed, install verified, helper-gated, relay-gated, staged, read-only, inventory-only, or otherwise limited. Those features may change, break, be removed, or lack the same support coverage as generally available hosted features.
Remote desktop access is available only where policy, role, endpoint license, direct-agent support, helper capability, and relay connectivity are satisfied. Clipboard and file transfer may remain separately gated or unavailable on some platforms.
11. Third-party services
TvRMM uses third-party services for hosting, payment processing, email delivery, DNS, security, analytics, source control, and operations. The Subprocessor List identifies the main providers used to support the service.
Third-party services may have their own terms, restrictions, uptime, and processing rules. TvRMM is not responsible for third-party failures outside its reasonable control, but will use commercially reasonable efforts to choose vendors aligned with the service's customer protection stance.
12. Confidentiality
Each party may receive non-public information from the other. The receiving party must use reasonable care to protect confidential information and may use it only to perform under these Terms, comply with law, or protect its rights. Confidentiality obligations do not apply to information that is public, independently developed, lawfully received from another source, or disclosed with permission.
13. Feedback
Customers may submit feature requests, ideas, bug reports, and suggestions. TvRMM may use that feedback without restriction or compensation, but will not intentionally publish customer-confidential details without permission.
14. Intellectual property
vanRoojen LLC and its licensors retain all rights in TvRMM software, service design, documentation, trademarks, and related technology. Customers receive a limited, non-exclusive, non-transferable right to use hosted TvRMM during the subscription term, subject to these Terms.
Customers may not copy, resell, reverse engineer, or create derivative services from TvRMM except as allowed by law or by written permission.
15. Disclaimers
TvRMM is provided on an "as is" and "as available" basis except where a separately signed agreement says otherwise. vanRoojen LLC disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free operation to the maximum extent permitted by law.
TvRMM does not replace customer backups, endpoint hardening, change-management review, security monitoring, compliance review, legal advice, or professional judgment.
16. Limitation of liability
To the maximum extent permitted by law, vanRoojen LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, replacement services, or loss of goodwill.
To the maximum extent permitted by law, vanRoojen LLC's aggregate liability for claims related to the service will not exceed the greater of the amount paid by the customer for TvRMM during the 3 months before the event giving rise to the claim or 100 U.S. dollars.
These limits do not apply where prohibited by law or to obligations that cannot legally be limited.
17. Customer indemnity
Customers will defend and indemnify vanRoojen LLC from claims arising from unauthorized endpoint management, unlawful use, customer scripts or commands, customer data, violation of the Acceptable Use Policy, or breach of these Terms, except to the extent caused by vanRoojen LLC's own willful misconduct.
18. Suspension and termination
Customers may cancel according to the Billing, Refund, and Cancellation Policy. TvRMM may suspend or terminate access for non-payment, security risk, unlawful use, abuse, material breach, or service integrity reasons.
TvRMM may delete an inactive unpaid account or tenant when all of the following are true: no real agent has been online for 30 or more days, no tenant owner or administrator has logged in for 90 or more days, and no billing setup exists for the account. Where practical, TvRMM should prefer notice before deletion, but abandoned accounts may be removed to protect the service, reduce retained data, and avoid carrying unused tenant records indefinitely.
Termination does not remove payment obligations already incurred, confidentiality obligations, liability limits, export/delete provisions, or other provisions that by their nature should survive.
19. Changes
TvRMM may update these Terms and related policies. Material changes should be announced through the website, portal, email, or other reasonable notice. Changes will not be used to silently remove the core customer protections described in the public promises.
20. Governing law and disputes
Unless a signed order form says otherwise, these Terms are governed by the laws of the jurisdiction where vanRoojen LLC is organized, without regard to conflict-of-law rules. Courts with jurisdiction over vanRoojen LLC's principal office will be the venue for disputes, unless mandatory law requires a different venue.
Before filing a claim, each party should give the other a reasonable opportunity to resolve the dispute informally.
